General Provisions<\/h5><ul><li>These Terms and Conditions (\u201cTerms\u201d) govern the Passenger&#039;s use of the TAPSi application, including digital services, functionalities, payments, and communications.<\/li><li>By using the application, the Passenger acknowledges that they have read, understood, and fully accept these Terms.<\/li><li>TAPSi reserves the right to change these Terms at any time. Changes take effect immediately upon publication on the App or website.<\/li><li>TAPSi is a Portuguese electronic platform regulated by Law No. 45\/2018 and does not provide transportation services. Transportation services are exclusively performed by licensed TVDE operators and drivers certified by IMT.<\/li><\/ul><h5>2. Definitions<\/h5><ul><li>Passenger \/ User \u2013 person requesting a service through TAPSi.<\/li><li>TAPSi Platform \u2013 an application and website that mediates transportation requests.<\/li><li>TAPSi Digital Services \u2013 technology, geolocation, algorithms, payments, and communication.<\/li><li>TVDE Operator \u2013 a company licensed by IMT that provides Transportation Services.<\/li><li>TVDE driver \u2013 certified professional responsible for driving.<\/li><li>In-App Payment \u2013 an electronic payment method authorized by the Passenger.<\/li><li>Fare \/ Trip Price \u2013 amount owed by the Passenger to the TVDE Operator for the transportation.<\/li><\/ul><h5>3. Platform Usage<\/h5><ul><li>The passenger must be at least 18 years old.<\/li><li>TAPSi may suspend or terminate accounts in cases of fraud, misuse, inappropriate behavior, violation of these Terms, creation of multiple accounts, false identities, or system manipulation.<\/li><li>It is prohibited to: violate Portuguese law, use the App for illegal purposes, manipulate geolocation or route, create conflicts with Drivers, damage vehicles.<\/li><\/ul><h5>4. TAPSi Registration and Account<\/h5><ul><li>To use the application, the Passenger must provide their full name, a valid mobile phone number, a valid payment method, and explicit acceptance of the GDPR Privacy Policy.<\/li><li>TAPSi may request additional verification and reserves the right to limit functionalities until data validation.<\/li><\/ul><h5>5. Nature of the Service<\/h5><ul><li>TAPSi is not a transport operator, does not employ drivers, and does not own the vehicles.<\/li><li>TAPSi provides technology, communication, geolocation, payment processing, digital security features, and user support.<\/li><li>All responsibility for transportation, trip safety, legal compliance with TVDE regulations, and the driver&#039;s conduct rests with the TVDE Operator.<\/li><li>TAPSi does not guarantee permanent availability, and technical interruptions, network failures, GPS, server or map issues may occur.<\/li><\/ul><h5>6. Prices and Tariff Structure<\/h5><ul><li>The passenger will be informed of the estimated price before the trip.<\/li><li>The final price includes distance, time, traffic, dynamic pricing, category, operating costs, technology costs, processing costs, and the TVDE Operator&#039;s policy.<\/li><li>All technological, operational, and banking processing costs are included in the final price presented to the passenger.<\/li><li>The price may change when the Passenger changes the destination, route, travel time, or when there are additional tolls.<\/li><li>TAPSi may correct values in case of error, fraud, or abuse.<\/li><\/ul><h5>7. Payments<\/h5><ul><li>Payment exclusively via In-App Payment.<\/li><li>The passenger authorizes card tokenization, automatic charges, and repeated attempts in case of failure.<\/li><li>If payment is not made, the account may be suspended, sent for collection, or access may be blocked again.<\/li><li>TAPSi is not responsible for bank failures, card limits, MBWay, chargebacks, or delays.<\/li><\/ul><h5>8. Cancellations and No-Shows<\/h5><ul><li>Cancellation is free within the indicated timeframe; after that, a fee may apply. No-shows will result in a fee equivalent to the minimum fare.<\/li><li>TAPSi can correct values in case of fraud.<\/li><\/ul><h5>9. Passenger Conduct<\/h5><ul><li>Respect, hygiene, no smoking, no drug use, no transporting prohibited materials, no damaging the vehicle, and obeying the law.<\/li><\/ul><h5>10. Lost Items<\/h5><ul><li>TAPSi is not responsible for any items left in the vehicle. Contact can be facilitated but is not guaranteed.<\/li><\/ul><h5>11. Evaluations<\/h5><ul><li>Abusive reviews may result in suspension.<\/li><\/ul><h5>12. Responsibility<\/h5><ul><li>TAPSi is not responsible for delays, traffic, GPS, network, technical failures, driver or passenger conduct, accidents, damage, lost items, or app unavailability.<\/li><li>Maximum liability limited to the total cost of the trip.<\/li><li>TAPSi is not liable for indirect losses, lost profits, moral or commercial damages.<\/li><\/ul><h5>13. Data Protection (GDPR)<\/h5><ul><li>Data processed in accordance with GDPR. Passengers may request access, rectification, or deletion. Essential data may be retained as required by law.<\/li><\/ul><h5>14. Intellectual Property<\/h5><ul><li>All content on TAPSi is the exclusive property of TAPSi.<\/li><\/ul><h5>15. Account Closure<\/h5><ul><li>Account termination may occur due to fraud, abuse, dangerous behavior, non-payment, violation of Terms, unjustified chargeback, or manipulation.<\/li><\/ul><h5>16. Law and Jurisdiction<\/h5><ul><li>Portuguese law and courts of the Coimbra district.<\/li><\/ul><h5>17.
