TVDE TAPSi Drivers
1. General Provisions
- These Terms and Conditions (“Terms”) govern the use of the TAPSi Driver application by TVDE professionals.
- By using the platform, the Driver declares that they have read, understood, and fully accept these Terms.
- TAPSi reserves the right to modify these Terms at any time. Changes will take effect immediately upon publication on the App or website.
- TAPSi is a digital platform registered in Portugal that does not provide transportation services. Transportation is always provided by licensed TVDE Operators, in accordance with Law 45/2018.
- TAPSi does not employ drivers, does not own vehicles, and assumes no responsibility for the execution of trips.
2. Driver Requirements
- The driver must possess: a valid TVDE driver's certificate; identification document; an up-to-date criminal record check; a medical certificate; mandatory insurance; and completed TVDE training.
- The driver agrees to keep all documentation valid and up-to-date.
- Any irregularity may result in immediate suspension.
3. Vehicle and Technical Requirements
- Vehicles must fully comply with the TVDE Law. The driver is solely responsible for maintenance. TAPSi is not responsible for damage, breakdowns, or incidents.
4. Using the Application
- Drivers should keep their GPS active, mobile data enabled, and the latest version updated.
- Forbidden: manipulating location, using external apps, accepting rides outside the app, sharing accounts, using someone else's account, or providing illegal transportation.
5. Professional Conduct
- Respect for the passenger, safety, vehicle hygiene, following the app's route, no smoking, no alcohol or drug use, no transporting hazardous materials.
6. Acceptance of Trips
- Abusive refusals and repeated cancellations may result in suspension.
7. Evaluation System
- Very low ratings may lead to suspension. Serious complaints may result in permanent deactivation.
8. Compensation, Commissions and Payments
- The base fare belongs to the TVDE Operator. The driver receives payment according to the agreement with the Operator. TAPSi may apply operational, technological, banking, and commission fees. TAPSi is not responsible for bank delays, refusals, or external failures.
9. Driver Responsibility
- The driver is responsible for safety, driving, the condition of the vehicle, any forgotten items, and compliance with TVDE (Transport Vehicle with Driver) regulations. TAPSi assumes no responsibility for incidents.
10. Cancellations and No-Shows
- Drivers may receive compensation in case of no-show. TAPSi may correct fares for abuse or fraud.
11. Responsibilities and Limitations
- TAPSi is not responsible for GPS errors, network failures, server outages, unavailability, passenger behavior, damages, conflicts, fines, or infractions. TAPSi's maximum liability is zero euros.
12. Data Protection (GDPR)
- Data processed in accordance with GDPR. TAPSi may retain essential data for security, fraud prevention, and legal obligations.
13. Account Closure
- Accounts may be suspended for fraud, invalid documents, misuse, low ratings, aggressive behavior, illegal transportation, app manipulation, account sharing, systematic refusals, and violation of the TVDE Law. Suspensions may be permanent and without prior notice.
14. Applicable Law and Jurisdiction
- Governed by Portuguese law. Disputes are resolved in the courts of the Coimbra district.
