Terms and Conditions
TAPSi passengers
1. General Provisions
- These Terms and Conditions (“Terms”) govern the Passenger's use of the TAPSi application, including digital services, functionalities, payments, and communications.
- By using the application, the Passenger acknowledges that they have read, understood, and fully accept these Terms.
- TAPSi reserves the right to change these Terms at any time. Changes take effect immediately upon publication on the App or website.
- TAPSi is a Portuguese electronic platform regulated by Law No. 45/2018 and does not provide transportation services. Transportation services are exclusively performed by licensed TVDE operators and drivers certified by IMT.
2. Definitions
- Passenger / User – person requesting a service through TAPSi.
- TAPSi Platform – an application and website that mediates transportation requests.
- TAPSi Digital Services – technology, geolocation, algorithms, payments, and communication.
- TVDE Operator – a company licensed by IMT that provides Transportation Services.
- TVDE driver – certified professional responsible for driving.
- In-App Payment – an electronic payment method authorized by the Passenger.
- Fare / Trip Price – amount owed by the Passenger to the TVDE Operator for the transportation.
3. Platform Usage
- The passenger must be at least 18 years old.
- TAPSi may suspend or terminate accounts in cases of fraud, misuse, inappropriate behavior, violation of these Terms, creation of multiple accounts, false identities, or system manipulation.
- It is prohibited to: violate Portuguese law, use the App for illegal purposes, manipulate geolocation or route, create conflicts with Drivers, damage vehicles.
4. TAPSi Registration and Account
- To use the application, the Passenger must provide their full name, a valid mobile phone number, a valid payment method, and explicit acceptance of the GDPR Privacy Policy.
- TAPSi may request additional verification and reserves the right to limit functionalities until data validation.
5. Nature of the Service
- TAPSi is not a transport operator, does not employ drivers, and does not own the vehicles.
- TAPSi provides technology, communication, geolocation, payment processing, digital security features, and user support.
- All responsibility for transportation, trip safety, legal compliance with TVDE regulations, and the driver's conduct rests with the TVDE Operator.
- TAPSi does not guarantee permanent availability, and technical interruptions, network failures, GPS, server or map issues may occur.
6. Prices and Tariff Structure
- The passenger will be informed of the estimated price before the trip.
- The final price includes distance, time, traffic, dynamic pricing, category, operating costs, technology costs, processing costs, and the TVDE Operator's policy.
- All technological, operational, and banking processing costs are included in the final price presented to the passenger.
- The price may change when the Passenger changes the destination, route, travel time, or when there are additional tolls.
- TAPSi may correct values in case of error, fraud, or abuse.
7. Payments
- Payment exclusively via In-App Payment.
- The passenger authorizes card tokenization, automatic charges, and repeated attempts in case of failure.
- If payment is not made, the account may be suspended, sent for collection, or access may be blocked again.
- TAPSi is not responsible for bank failures, card limits, MBWay, chargebacks, or delays.
8. Cancellations and No-Shows
- Cancellation is free within the indicated timeframe; after that, a fee may apply. No-shows will result in a fee equivalent to the minimum fare.
- TAPSi can correct values in case of fraud.
9. Passenger Conduct
- Respect, hygiene, no smoking, no drug use, no transporting prohibited materials, no damaging the vehicle, and obeying the law.
10. Lost Items
- TAPSi is not responsible for any items left in the vehicle. Contact can be facilitated but is not guaranteed.
11. Evaluations
- Abusive reviews may result in suspension.
12. Responsibility
- TAPSi is not responsible for delays, traffic, GPS, network, technical failures, driver or passenger conduct, accidents, damage, lost items, or app unavailability.
- Maximum liability limited to the total cost of the trip.
- TAPSi is not liable for indirect losses, lost profits, moral or commercial damages.
13. Data Protection (GDPR)
- Data processed in accordance with GDPR. Passengers may request access, rectification, or deletion. Essential data may be retained as required by law.
14. Intellectual Property
- All content on TAPSi is the exclusive property of TAPSi.
15. Account Closure
- Account termination may occur due to fraud, abuse, dangerous behavior, non-payment, violation of Terms, unjustified chargeback, or manipulation.
16. Law and Jurisdiction
- Portuguese law and courts of the Coimbra district.
